It is allowed, UNCLOS right of transit in straits. Unfortunately UNCLOS can't prevent the spy ship from gathering intelligence covertly during transit. It's not supposed to gather Intel, but it's not currently possible to prove in ICC that it is.
Besides, all Bluewater navy states do the same.
