The jet-ski escapee is Chinese rights activist Kwon Pyong. He had posted pictures on social media mocking Chinese President Xi Jinping, and spent time in jail in China for subversion.

It is still technically illegal to be a communist or support the party or "Communist-action" organizations in the US. Even though as far as I know, the US government has never "freely admitted" arresting someone for being communist
